Employees Must Feel Free to Report Their Injury

One of the main reasons why our clients tell us that they were hestitant to file a workers' compensation cliam is because they in fear of reliation from employers. 
We absolutely understand that fear as, unfortunately, we have seen it more often than we care to share. Employers use bullying, diversion tactics to try and intimidate employees into not pursuing their rights.
In December, new OHSA regulations went into effect to try and ease that fear...
  1. Employers must inform employees of their right to report work-related injuries and illnesses, free from retaliation. Employers should make it clear in their employee handbooks that employees have the right to report workplace injuries.
  2. An employer's procedure for reporting work-related injuries and illnesses must be reasonable and must not deter or discourage employees from reporting. 
  3. An employer may not retaliate against employees for reporting work-related injuries or illnesses. 

We have the highest of hopes that these guidelines will help reduce an employee's fears, but we know full well that there are countless employers who will just continue going on about their business and disregarding workers' rights as usual.
