Working with faulty/malfunctioning equipment poses a severe risk to hard-working employees, yet employers continually fail to update/maintain the equpiment.
The U.S. Occupational Safety and Health Administration cited Bay Fabrication for workplace safety violations after two workers were injured nine days apart.
On Wednesday, OSHA issued citations for a willful violation, a repeated violation, an other-than-serious violation and two serious violations to the manufacturer of muffler components for the automotive industry. If the violations are upheld, Bay Fabrication, 2929 Walker Drive, could face $219,242 in penalties for failing to re-evaluate machine safety procedures and for exposing workers to the same hazards even after two employees were injured.
On Thursday, Bay Family Companies Human Resources Director Joe Hilke said the company is reviewing the citations right now and has not decided whether to accept them and pay the fines or challenge them.
"We do take our obligation to workforce safety seriously and have a long-standing commitment to safety," Hilke said.
The violations are based on OSHA's investigation of two incidents that occurred last year. On July 21, a man's left hand was smashed by a molding machine tamp head as he was removing a mold from the machine. OSHA found the machine's safety interlock was not functioning because it was damaged.
Nine days later, on July 30, another man lost part of his left middle finger when a molding machine cycled and caught his finger in an unguarded pinch point.
OSHA's investigation also found Bay Fabrication did not guard operating parts on various machines in the factory, improperly installed safety guards on machines and did not record work-related injuries in its illness and injury logs.
It's incredible, but unfortunately all-too-common, to see that an employer can continue to skirt proper safety measures and continually put their hard-working employees at risk for injury.
When accidents at the workplace occur, these negligent employers need to be held liable! We fight for you, the worker. We fight to ensure your rights are upheld, and if an unfortunate injury should occur, we fight to ensure you receive your maximum compensation.
You shouldn't have to endure even more burden due to workplace injury that could have been prevented.
Even one workplace injury is one too many...but to hear of employers with multiple violations...it's absolutely horrific.
