We have noticed the tendency for insurance companies to do one of two things, sometimes both:
- Issue a generic rejection letter. Insurance companies have the tendency to immediately deny a claim with a generic letter within two or three weeks. The letter may state your claim did not arise out of your injury or that it is not sufficient for workers' compensation. But the insurance company, not the worker, is responsible for lost wages and medical bills.
- Refer claim to biased medical personnel. Injured workers are often sent to a company doctor. Without ordering appropriate testing, the doctor will inevitably say the injured worker simply experienced some back strain and send them back to work. Because the doctor is paid by the insurance company, their bias towards their employer cannot be ignored. In some cases, a Nurse Case Manager will be involved, and injured workers have said the NCM was difficult to deal with and spoke to doctors behind their back. The whole purpose in sending you to biased medical personnel is to get you back to work as soon as possible.
